HISTORICAL HOMOSEXUAL OFFENCES — EXTINGUISHMENT OF CONVICTIONS

171. Hon Alison Xamon to the Leader of the House representing the Attorney General:

I refer to the WA Labor commitment to implement a process for people who have historical sex convictions relating to consensual homosexual acts expunged, and I ask:

(a) can the Minister please advise whether this process has been developed;

(b) if yes to (a), please advise what this process will entail;

(c) if no to (a), why not;

(d) if no to (a), when will a process be developed;

(e) will the process include the ability of a family member or spouse to apply in the case that the person is deceased; and

(f) if no to (e), why not?

Hon Sue Ellery replied:

(a) Yes.

(b) A bill is currently being drafted.

(c) Not applicable.

(d) Not applicable.

(e) It is intended that such a provision will be included in the Bill.

(f) Not applicable.
